Introduction and Acceptance
By accessing or using Skillcape Software LLC, you agree to comply with and be bound by the terms and conditions of this Agreement. Please read this Agreement carefully before accessing or using Skillcape Software LLC. If you do not accept this Agreement, you may not access or use our Application.
Intellectual Property
Our Services and related content (and any derivative works or enhancements thereof), including but not limited to all text, illustrations, documentation, images, software, scripts, graphics, photographs, information, content, materials, products, services, URLs, technology, documentation, and interactive features (collectively, "Service Content"), as well as all related intellectual property rights, belong to us, our licensors, or both. In addition, all trademarks and trade names that may appear on our Services belong to us or designated third parties. Except for the limited rights granted to you under these Terms of Use, you do not acquire any rights to the Service Content.
Access and Use
Our Service Content is provided for your personal and commercial use. If you use our pre-made logo templates to create final products, such products must be unique implementations of the Service Content that are substantially different from the original Service Content and require time, effort, and skill to produce. The original content must be modified in some way to become new content and must be sufficiently different to avoid confusion.
We may offer some of our Services for free, charge a one-time fee, subscription fee, or provide other services under other lawful pricing structures. In all cases, our Services are not sold directly to you; rather, you are granted or purchase a limited license to use our Services.
Unless expressly permitted by these Terms of Use, you may not:
(i) Remove, alter, obscure, or distort any copyright, trademark, or other proprietary notices contained in our Services or Service Content;
(ii) Bypass, disable, or otherwise interfere with our security-related features;
(iii) Use automated devices or manual processes to copy or "scrape" Service Content for any purpose;
(iv) Collect any personally identifiable information from our Services;
(v) Attempt to interfere with the normal operation of our Services, or damage, overload, or disable the Services;
(vi) Decompile, reverse engineer, or disassemble any portion of our software or Service Content;
(vii) Use network monitoring software to determine the Service architecture or extract usage data;
(viii) Encourage any violation of civil or criminal laws, or impersonate other users, individuals, or entities (e.g., using another person's access to the Services);
(ix) Take any action that restricts or hinders other users from using or enjoying our Services.
The Application may contain features that allow you to access content on the internet (e.g., through Google Image Search). By using such features, you acknowledge and agree that such content may be subject to third-party rights, including but not limited to copyright. You are solely responsible for the lawful use of such content, including obtaining any necessary licenses (if applicable).
As part of the Services, you may use certain Service Content (particularly stock images) to create derivative works within the Application. Under these Terms of Use, you may use such derivative works for personal purposes; however, you acknowledge and agree that the same Service Content will continue to be available to other Application and Service users. Removal of any content from gallery images or other Service Content requires a separate agreement with us and payment of the applicable licensing fee. However, even if an agreement is reached and the content is removed from the Application, it does not prevent users from continuing to use similar derivative works previously created.
Disclaimer
You expressly agree that your use of our Services is at your sole risk. Our Services and Service Content (including software) are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied.
We expressly disclaim any warranties that:
(i) The Application or our Services will meet your specific requirements;
(ii) The operation of the Application or our Services will be uninterrupted, timely, secure, or error-free;
(iii) The results obtained from using the Services will be accurate or reliable;
(iv) The quality of any products, services, information, or other materials purchased or obtained by you through the Application or our Services will meet your expectations;
(v) Any warranties of title, non-infringement, or fitness for a particular purpose; and
(vi) Any errors in the Application, our Services, or Service Content will be corrected.
To the fullest extent permitted by applicable law, we shall not be liable for any direct or indirect damages arising out of your use of the Application, our Services, or these Terms of Use (even if we have been advised of the possibility of such damages). If you are dissatisfied with the Application or our Services (including but not limited to the Service Content), your sole remedy is to stop using the Application and our Services.
Termination
We reserve the right to block your access to our Services at any time, for any reason, in our sole discretion, including but not limited to your failure to comply with these Terms of Use. You agree that the Company shall not be liable to you or any third party for blocking your access to our Services. Upon termination, you must immediately delete the Application from the device on which it is installed. All data available in the Application or Services may be deleted. You are responsible for copying all such data before deletion.
Amendments; Additional Terms
Skillcape Software LLC reserves the right to change the terms and conditions of this Agreement, and such modifications will take effect immediately. If you object to any subsequent revisions to the Terms of Use, you must immediately cease using our Services.
